Legal and regulatory framework of nuclear safety in Ukraine: strategic directions and long-term prospects

Abstract

The article examines the legal and regulatory framework for ensuring nuclear safety in Ukraine. It is determined that nuclear safety issues require comprehensive legal and scholarly analysis in order to form effective state regulatory mechanisms, strategic directions for increasing the resilience of critical infrastructure and ensuring the adaptation of national legislation to European Union standards. The article reviews scholarly and theoretical developments related to the subject matter, which emphasize the relevance of the chosen topic. The author analyzes provisions of the Law of Ukraine «On National Security», current legislative trends in the field of ensuring nuclear safety. In particular, the provisions of the draft Law of Ukraine «On Amendments to the Law of Ukraine «On National Security of Ukraine» regarding the implementation of the Strategy for Chemical, Biological, Radiation and Nuclear Safety» No. 15128 dated April 3, 2026 are studied. It is noted that the adoption of the draft law will contribute to the formation of a comprehensive strategic document of longterm planning and a clear interdepartmental mechanism for interaction between security and defense forces, health care and civil protection agencies in the event of chemical, biological, radiological and nuclear incidents, which is critical importance in the context of martial law and the need to strengthen national resilience, increase readiness to respond to chemical, biological, radiological and nuclear threats. Based on the results of this legal study of nuclear safety issues in Ukraine, the study concludes that the priority of developing the nuclear safety sector as a component of the national security of the state and the essential basis for the sustainable functioning of the economic system of Ukraine.
