The Coherence of Small Enterprises Support Tools: Legal Aspect

Problem setting. The reform of Ukrainian legislation in the field of entrepreneurship, including small and mediumsized enterprises (hereinafter referred to as SME), requires systematic and multi-sectoral regulation. As Ukrainian legislation is being adapted to EU law, a consistent step is to analyze the relevant consideration of EU law requirements for the systematic development of Ukraine’s SME law and its compliance with EU documents governing SME activity.
Analysis of recent researches and publications. Investigations into specific problems of support for small and medium-sized enterprises were undertaken by I. Veryzhenko, S. G. Dryha, D. V. Zadykhailo, A. V. Komirnyi, D.V. Lichak, N.M. Levchenko, V. M. Pashkov, M. G. Pivovarov, G. I. Skoryk, G. I. Trevoho, I. V. Trush and others. However, it is necessary to analyze the existing systematization of support and development tools for SMEs in certain areas, which will help to create favorable conditions for SMEs to function properly in the course of adaptation to EU law.
Target of research. The purpose of the article is to analyze the state of implementation of the requirements of the «Small Business Act for Europe» of 25.06.2008.
Article’s main body. In view of the harmonization of Ukrainian legislation with EU law governing the activity of SMEs, the content of one of the fundamental legal acts of the European Union in the field of support and promotion of SMEs – the Small Business Act for Europe of 25.96.2008 (hereinafter referred to as «the Act»), which sets out 10 principles underpinning policy making and implementation at both EU and Member State level. The purpose of our research is to analyze the implementation of these principles of EU legislation in the regulatory acts of Ukraine.
Conclusions and prospects for the development. Based on the above, we can conclude that at the present stage of development of national legislation there is a process of gradual harmonization of legal acts of Ukraine with the «Small Business Act for Europe». In our opinion, first of all, it is necessary to ensure the possibility of systematic development and coordination of all means of economic and legal regulation for the purpose of quick and effective involvement of SMEs of various forms of state aid and support, as well as to legally determine for such entities the advantages in carrying out business activity, especially in innovative sectors of the Ukrainian economy. And secondly, it is necessary to create QDan effective monitoring structure for the functioning of an effective SME support system.
